MEES & commercial EPC ratings

The general position

Under MEES, non-domestic landlords in England and Wales are prevented from letting property below the minimum EPC rating in force, unless a valid exemption is registered on the PRS Exemptions Register. The minimum rating and the scope of properties covered has evolved since the regulations were introduced.

Consultations and future changes

The government has consulted on tightening the minimum standard for non-domestic property. Where changes have been consulted on but not yet enacted, we treat them as proposals — not current law. Always check the current legal position before acting on rating requirements.

Exemptions

Where meaningful improvements cannot be delivered — for example due to cost, consent or fabric constraints — a valid exemption may be registrable on the PRS Exemptions Register. Exemptions are time-limited and property-specific.

Poor EPC ratings

Where a commercial property rates F or G, options include improving the rating through works recommended in the EPC, registering an appropriate exemption, or reviewing the marketing strategy. Our team can help you understand the recommendations report.
