New lettings
A landlord granting a new lease of non-domestic premises must provide a valid EPC to the prospective tenant free of charge, and the rating must be shown in marketing particulars. Since April 2023 in England and Wales, it has been unlawful to continue to let non-domestic property rated F or G unless a valid exemption is registered on the PRS Exemptions Register.
Renewals and regears
A lease renewal or the grant of a new lease to a sitting tenant is a letting event and needs a valid certificate. Simple assignments of an existing lease generally do not trigger a new EPC, but the continuing-let MEES position still applies to the landlord.
Multi-let buildings
Where units are designed for separate occupation, each demise usually requires its own certificate. Assessing several units in one visit is materially cheaper than instructing them individually as each letting arises.
